2. Acceptance of Terms

By accessing, browsing, registering on, or purchasing from this Site, you:

  • Confirm that you have read and understood these Terms;

  • Agree to be legally bound by them;

  • Warrant that you are legally capable of entering into binding agreements.

If you do not agree, you must not use this Site.


3. Nature of Products & Medical Disclaimer

Homedoc supplies home-use health screening tests, wellness products, and medical devices intended for personal monitoring and informational purposes.

Homedoc does not provide medical advice, diagnosis, or treatment.

The Products and all content on this Site:

  • Are not a substitute for professional medical advice;

  • Should not be relied upon as the sole basis for medical decisions;

  • Must be used strictly according to manufacturer instructions.

You must consult a qualified healthcare professional regarding:

  • Any medical condition;

  • Interpretation of results;

  • Treatment decisions.

If you believe you are experiencing a medical emergency, contact emergency services immediately.


4. Pricing and Availability

  • All prices are displayed in South African Rand (ZAR).

  • VAT at 15% is included unless otherwise stated.

  • Delivery charges are calculated separately at checkout.

  • Prices may change without prior notice.

  • All Products are subject to stock availability.

If a pricing error occurs, we reserve the right to cancel the order and issue a full refund.


5. Promotions and Discount Codes

  • Promotions are subject to availability and specific conditions.

  • Discount codes may not be combined unless expressly stated.

  • Certain major promotional days (e.g., Black Friday) may exclude previously issued discount codes.

  • We reserve the right to withdraw promotions at any time.


6. Orders and Payment

An order constitutes an offer to purchase.

A sale is concluded only once:

  • Payment is authorised (card transactions); or

  • Funds reflect in our bank account (EFT).

We reserve the right to refuse or cancel orders in cases of suspected fraud, pricing errors, or stock unavailability.

Ownership of Products remains with Homedoc until full payment is received.

Risk passes to you upon delivery to the address provided.


7. Shipping and Delivery

We use reputable courier partners including (but not limited to):

  • Fastway

  • FedEx

  • The Courier Guy

Delivery timeframes are estimates only.

Homedoc is not liable for delays caused by:

  • Courier delays

  • Strikes

  • Force majeure events

  • Incorrect address details provided by you

You are responsible for ensuring delivery information is correct.

For international deliveries, import duties and taxes are the responsibility of the customer.


8. Returns, Cooling-Off & CPA Compliance

8.1 CPA Section 44 Cooling-Off (Distance Sales)

In terms of Section 44 of the Consumer Protection Act, consumers may cancel certain online purchases within 7 days of delivery.

However, the cooling-off right does not apply to:

  • Products that have been opened;

  • Products sealed for health or hygiene reasons once unsealed;

  • Rapid diagnostic tests, pregnancy tests, ovulation tests, urinalysis strips, and similar screening kits once opened.

If cancellation is valid under CPA, the customer is responsible for return shipping costs.


8.2 CPA Section 56 – Six Month Implied Warranty

In terms of Section 56 of the CPA:

All goods carry a 6-month implied warranty against defects.

If a Product is defective within 6 months of delivery, you may return it for:

  • Repair

  • Replacement

  • Refund

at our election in accordance with the CPA.

This does not apply to defects caused by:

  • Misuse

  • Incorrect storage

  • Failure to follow instructions

  • Normal wear and tear


8.3 Hygiene & Medical Product Policy

Due to the medical and hygienic nature of certain Products:

Opened rapid tests and similar diagnostic kits cannot be returned unless defective.

Medical devices (e.g., blood pressure monitors, nebulisers, oximeters) may only be returned if:

  • Unused;

  • In original sealed packaging;

  • Or defective under CPA provisions.


9. Intellectual Property

All content on this Site, including:

  • Logos

  • Product packaging designs

  • Instruction manuals

  • Text

  • Graphics

  • Layouts

are the property of DNX Medical (Pty) Ltd or used under license.

Unauthorised copying, reproduction, modification, or distribution is prohibited and may result in legal action under the Copyright Act.


10. Acceptable Use

You may not:

  • Use the Site for unlawful purposes;

  • Attempt unauthorised access;

  • Upload malicious software;

  • Post defamatory or unlawful content.

You indemnify Homedoc against any loss resulting from misuse.


11. Limitation of Liability

Use of this Site and its Products is at your own risk.

To the maximum extent permitted by law:

  • Homedoc shall not be liable for indirect or consequential loss;

  • Liability shall not exceed the purchase price of the Product giving rise to the claim.

Nothing in these Terms limits rights granted under the Consumer Protection Act or liability for gross negligence or defective products under applicable law.


12. POPIA & Data Protection

Personal information is processed in accordance with:

  • The Protection of Personal Information Act (POPIA)

  • Our Privacy Policy

By using this Site, you consent to the processing of your personal information for purposes related to:

  • Order fulfilment

  • Customer service

  • Legal compliance


13. Security

You are responsible for maintaining the confidentiality of your account credentials.

We take reasonable steps to secure transactions, but no online transmission is guaranteed to be completely secure.


14. Force Majeure

Homedoc shall not be liable for failure or delay in performance caused by circumstances beyond reasonable control, including but not limited to:

  • Natural disasters

  • Strikes

  • Civil unrest

  • Power outages

  • Government restrictions

  • Pandemic-related disruptions


15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa.

Disputes may be:

  • Submitted to a court of competent jurisdiction; or

  • Referred to arbitration under the Arbitration Foundation of Southern Africa (AFSA).


16. Amendments

We reserve the right to amend these Terms at any time.

Continued use of the Site constitutes acceptance of updated Terms.
